傳銷真實名稱是"金字塔騙術"- Pyramid Scheme
層壓式推銷 (金字塔騙術) 層壓式推銷 (Pyramid scheme),在台灣又稱老鼠會,是一種不能持久的商業運作模式,參與者通過介紹其他人加入而賺取傭金,這些傭金來自新會員的入會費,如此類推,一層壓一層。公司通常沒有提供任何產品或服務,或者是以高出市價的價錢出售「產品」。在台灣取其有如鼠類繁殖速度而有老鼠會之別稱。這種推銷手法至少有100年的歷史。其他類似的手法為matrix scheme,但層壓式推銷(老鼠會)是一種不合法賺取傭金的行為。 大部分層壓式推銷試圖混淆視聽,把騙局包裝得複雜和似是而非。參與者付入會費後,要介紹其他人入會才有收入,上層的參與者可以分享下層參與者的入會費,一層壓一層,如金字塔一樣;金錢向上繳集,發起人是最終得益者。最受害的是最低層的參與者,因為他們若未能介紹其他人入會,只有付出,沒有回報。為了欺騙參與者,層壓式推銷通常牽涉假個案和假證據。 層壓式推銷術在不少地區屬刑事罪行,但有很多地區都以不干預商業運作為由不立法監管。只有少數地區透過公平交易法規來監管,使民眾得以分辨合法的傳銷活動。 |
歷史
美國層壓式推銷最早成立於1964年,由美國人威廉·派屈克在加州所創,當時的公司名為「假日魔法公司」,在短短的8年間其業績從第一年的52萬美元竄升至1972年的2.5億美元。大約同時成立的「佳線產品公司」也是「老鼠會」的傑作。1971年,美國貿易委員會有鑒於「老鼠會」在全美各地流竄發展,並帶來許多社會問題,於是率先控告「假日魔法公司」違反聯邦貿易委員會會法。同年加州政府也檢舉「佳線產品公司」的非法行為。到此,「老鼠會」無法在美國立足。於是開始跨國發展,在加拿大、歐洲、日本、中國等地都出現「老鼠會」的足跡。由於他們在各國市場崛起,謀取暴利,並引起了嚴重的社會問題,相繼被勒令停業。 層壓式推銷有很多不同版本,最早的模式是以信件行騙。信件寫上有5至10個地址的列表,收信人把表上第一個地址刪去,在表末加上自己和其他人的地址,成為新的列表,寫在新的信上,然後把此信連同指定的小額金錢寄去剛被刪的地址。寄信人希望程序一直重複,終有一天自己的地址成為列表上首個地址,接收累積的金錢。 層壓式推銷的成功視乎會員數目能否以指數級增長,所以層壓式推銷的英文是"pyramid"(金字塔),代表每向下一層會員人數就遞增。當會員人數越來越多,支持計劃運作的會員數目將會是天文數字,註定層壓式推銷不能持久,絕大部分參與者都要賠錢。 大規模的層壓式推銷曾於前蘇聯共和國發生。蘇聯解體後不久,當地的人對股票市場不熟悉,被誤導以為可以輕易獲得10倍以上利潤。最惡名昭彰的是俄羅斯的MMM騙局和阿爾巴尼亞的層壓式推銷騙案。 法例禁止 很多國家明文規定禁止層壓式推銷,但仍禁之不絕。純粹牽涉金錢的層壓式推銷已差不多絕跡,很多層壓式推銷都以售賣貨品作掩飾,卻以招攬會員為實。 禁止層壓式推銷的國家和地區 阿爾巴尼亞、澳洲、巴西、保加利亞、加拿大、中國、哥倫比亞、丹麥、多明尼加共和國、多米尼加、愛沙尼亞、法國、德國、 香港:根據香港法例第617章《禁止層壓式推銷法條例》,任何人明知而推廣層壓式推銷計劃,可處罰款$100萬及監禁7年。 匈牙利、冰島、伊朗、義大利、日本、馬來西亞、墨西哥、尼泊爾、荷蘭、紐西蘭、挪威、菲律賓、波蘭、葡萄牙、羅馬尼亞、南非、斯里蘭卡、瑞士、中華民國臺灣、泰國、土耳其、英國、美國 |

A pyramid scheme is an unsustainable business model that involves promising participants payment or services, primarily for enrolling other people into the scheme, rather than supplying any real investment or sale of products or services to the public. Various forms of pyramid schemes are illegal in many countries including Albania, Australia, Austria, Brazil, Canada, China, Colombia, Denmark, the Dominican Republic, Estonia, France, Germany, Hong Kong, Hungary, Iceland, Iran, Italy, Japan, Malaysia, Mexico, Nepal, the Netherlands, New Zealand, Norway, the Philippines, Poland, Portugal, Romania, Russian Federation, South Africa, Spain, Sri Lanka, Sweden, Switzerland, Taiwan, Thailand, Turkey, the United Kingdom, and the United States. These types of schemes have existed for at least a century, some with variations to hide their true nature, and because of this, many people believe that all multilevel marketing plans are also pyramid schemes. A successful pyramid scheme combines a fake yet seemingly credible business with a simple-to-understand yet sophisticated-sounding money-making formula which is used for profit. The essential idea is that a "con artist" Mr. X, makes only one payment. To start earning, Mr. X has to recruit others like him who will also make one payment each. Mr. X gets paid out of receipts from those new recruits. They then go on to recruit others. As each new recruit makes a payment, Mr. X gets a cut. He is thus promised exponential benefits as the "business" expands. Such "businesses" seldom involve sales of real products or services to which a monetary value might be easily attached. However, sometimes the "payment" itself may be a non-cash valuable. To enhance credibility, most such scams are well equipped with fake referrals, testimonials, and information. The flaw is that there is no end benefit. The money simply travels up the chain. Only the originator (sometimes called the "pharaoh") and a very few at the top levels of the pyramid make significant amounts of money. The amounts dwindle steeply down the pyramid slopes. Individuals at the bottom of the pyramid (those who subscribed to the plan, but were not able to recruit any followers themselves) end up with a deficit. |
